Good to know
Votes have their own rules.
Signing a form electronically is generally valid under the ESIGN Act and state UETA laws. But some HOA actions have specific rules in state law or in your governing documents. Many states set how owner votes, proxies and electronic voting must work (Florida, for example, has a specific statute for electronic voting in HOAs), and bylaws often say whether a board can act by written consent and whether it must be unanimous.
Before you use e-signatures for a vote, an election or a proxy, check your bylaws and your state's HOA or condominium act, or ask the association's attorney. MultiDocs is not a secret-ballot election system: the board can see who signed.
Notices of default or foreclosure tied to an owner's home should go out on paper, as your state law and documents require. This is general information, not legal advice.
Questions
HOA e-signature questions.
Can HOA board members sign a written consent electronically?
Generally, yes, if your bylaws and state law allow the board to act by written consent. Send it to each director, in order if you prefer, and keep the signed PDF with the minutes.
Can owners sign proxies electronically?
Often, but it depends on your state law and governing documents. Some states restrict proxies or set specific rules for electronic voting. Check before you rely on it.
Can owners attach plans to an architectural request?
Yes. Add an "ask for a document" field and the owner attaches photos or a PDF of the plans before signing.
Can we send a form to every owner at once?
Yes. Bulk send gives each owner their own copy: up to 20 on the free plan and up to 500 on the Team plan.
Do owners need to create an account?
No. They get a link by email or text and sign in their browser.
What does it cost an association?
Small associations can use the free plan, with 15 requests a month. The Team plan is $25 a month for the whole board and manager, with unlimited users.
